COMPANY OVERVIEW
RMC, a professional consulting firm with offices across the United States, provides full program management and dispute resolution services to a variety of clients for projects of varying types. Our firm is staffed with individuals specializing in program management and dispute resolution services to the engineering, construction, manufacturing, supply, computer and marine industries. Our collective educational training includes degrees/professional registrations in the areas of engineering (civil, mechanical, electrical and structural), construction, law, computer sciences, accounting and management. Our collective experience spans over the last four decades, including prior work experience attained while various individuals were employed by major constructors, engineering firms, government agencies, and construction claims firms. Our staff has worked on numerous projects for various public agencies and private owners. These services have included program management, claims avoidance and claims resolution services. Performance Measures and Indicators - preparation of plans and studies regarding contracting methods, ISO 9000 standards applicability to ship overhauls, and development of baseline schedules and budgets, and the creation of cost and schedule status reporting systems and the evaluation of same.
Process and Productivity Improvement - preparation of studies and reports to objectively assess whether performance objections were obtained and, if not, the reasons/causes therefore, and recommending solutions or alternatives to organizational or functional problems within an agency or for a particular project.
Program Audits and Evaluations - the evaluation of organizational structures to assess the efficiency and effectiveness of the interrelationships among departments, and recommending how to better coordinate efforts and communicate needs and requirements.
Claims Analysis - assisting government agencies in the analysis of claims brought against the government alleging cost overruns for labor, equipment and material plus extended costs of performance relating to additional field costs and extended (or unabsorbed) home office overhead. Services performed on an advisory basis, for preparation of a COFD, or once an appeal has been filed, before the agency's Board of Contract Appeals or the Court of Federal Claims. Assistance during an ongoing project may consist of an on-site review of perceived problems relating to cost and/or schedule issues. Assistance in the resolution of a dispute may entail one or more of the following tasks:
FACILITATION SERVICES - SIN 874-2
Our vast experience in the construction process, whether being involved in the initial planning concepts, contract development, establishing a partnering relationship, or becoming involved during project close-out, compliance audits or the claims resolution stage, offers a truly independent third party view of issues in dispute, which allows us a true understanding of the nature of the issues. This neutrality can serve well in the resolution of issues prior to, during and post construction between owner and design professional and owner and contractor. We can also serve as a go-between in internal disputes between agencies and departments regarding management and/or administrative tasks in order to identify conflicts or obstacles in the current system that need to be rectified.
The manner in which this can be accomplished can take a variety of forms, with the facts of the particular situation and the parties circumstances dictating the best approach to take in order to transition to an understanding between the parties.
TRAINING - SIN 874-4
Resolution Management offers a number of various one, two and three-day programs designed to educate and train personnel in dispute avoidance, mitigation and management for any type of land-based construction, new ship construction and overhauls, supply contracts and computer hardware and software contracts.
The method of instruction combines a number of formats including audio-visual, question and answer, group workshop, handout problems and individual testing. The topics can be customized to meet the level of attendee (i.e., management, staff, field, etc.) and to address problems specific to the agency/organization.
Courses are given at a location of the agency s choice at times chosen by the agency; however, experience has shown that the best learning environment per day is instruction in 1 hour increments with appropriate breaks at mid-morning, for lunch and at mid-afternoon. The agency is responsible for the cost of the site where the training is to be given, for any refreshments or lunch served, and for travel expenses incurred by the lecturers.
The instructors are Resolution Management employees experienced in the subject of discussion and skilled in the presentation of the material. We emphasize group participation in order to generate a wide variety of input and opinion. Questions are encouraged and responses from both the contractor s and owner s position are rendered.

Delivery Systems - identifying most advantageous method of contracting
based on goals and objectives.
Contract
Development - review and enhance agreements between owner and
design professional and owner and contractor to eliminate gaps or overlapping
responsibilities.
Milestone Schedule
Development - preparation of a "roadmap" by which
the early stages of project development can be monitored.
Work
Conformance/Feasibility Review - review of contract
drawings and technical specifications to verify that inconsistencies and
ambiguities do not exist between documents and are consistent with goals and
objectives.
Construction
Schedule Development - evaluate contractor's construction schedule to
ensure work is well-defined, consistent with owner intent and in compliance
with specified NAS, and review and comment on periodic updates.
On-Site Project
Monitoring -
use of personnel to monitor progress and the work of contractors on a periodic
basis, placing emphasis on adequate manning and work in accordance with the
approved construction schedule. Identifying problems, notifying owner,
establishing cause(s) and responsible party(ies), and proposing corrective
solutions.
Contract Management
- assist in ensuring that all contract administration functions are faithfully
followed, and re-defining and/or clarifying responsibilities to address areas
of concern based on actual conditions.
Change Order
Management - assist in the implementation of change
order cost control measures and verify that the pricing of changes is
consistent with the work being performed and sufficiently documented so as to
facilitate a reconciliation of actual to estimated costs, and promote the
development of a cost tracking system whereby the cost to perform changed work
is segregated for each change issued under the contract.
Application For
Payment Review - monthly support in reviewing/auditing
payment requests to confirm payment made for progress achieved, materials
purchased and stored on site, and ensuring that properly authorized contract
modifications and credits are accurately listed.
Contract Close-Out
Procedures -
ensure preparation of punch lists, accomplishment of corrective or remedial
work, warranties and guarantees are in place, procurement of all necessary
final approvals, provision of manuals, descriptive data and literature, and
necessary supporting documentation regarding outstanding payments.
ALTERNATIVE DISPUTE RESOLUTION
SERVICES - SIN 874-8
RMC staff members have served on numerous occasions in the capacity of expert witness. In this role, we have assisted public agency (as well as other) clients in attempting to reach a reasonable settlement via various methods. This has taken the form of negotiations with the other side and/or their expert and attorney, through mediation efforts by outside parties, and by assistance during a mini-trial. We have also served as expert witnesses who have testified at trials and arbitrations when interim methods were not successful.
A number of staff members have also served as mediators and arbitrators under the auspices of the American Arbitration Association. We have also participated in presenting partnering workshops to contractor and public agency personnel, which not only touch on the understanding of the partnering concept, but also to explain that partnering alone will not usually accomplish project goals established at the beginning of a job by all parties.
Different methods of dealing with this issue have been offered, and RMC has played a part in fostering a collaborative effort. Our involvement may take many forms:
Partnering - a process that achieves the
most success when initiated up-front and is accepted by upper management of all
participating parties, and which is then encouraged and implemented throughout
the ranks as work proceeds and issues arise. This involves working with project
participants to come together to understand and achieve common goals, realizing
there will be discrepancies and differing opinions, and dealing with problems
proactively and in a positive environment so as not to disrupt project rhythm
and avoid future problems.
Early Neutral
Evaluation - serve as an independent third party to
assist the contracting parties in a review of the issues in an attempt to reach
common ground. This method attempts to educate the parties as to the strengths
and weaknesses of their respective positions and to explain the possible
impacts to future progress if the outstanding issue(s) remain unresolved.
Neutral Expert - review the technical,
contractual, time and cost issues in dispute, and render an opinion regarding
entitlement and quantum, allocating responsibility among the parties. This
could entail a summary or a detailed review and evaluation of the parties
positions, with the extent of detailed review and analysis dependant upon the
parties desires.
Mediation - work with the parties to achieve a settlement by guiding
them to the point where the parties (and not the mediator) provide the
suggestions and proposals by which an agreement is achieved. Also understand
the parties' strengths and weaknesses and advise thereof in order to have each
side clearly understand the inherent risk of pursuing the matter further in
Court or before the Board. Typically involves a one or two-day session with all
involved parties. As a non-binding process, concessions can be offered, as
either party can reject the other side s offer without fear of hurting one s
position should the matter proceed to litigation, as the proceeding is viewed
as an attempt to negotiate a settlement and, thus, cannot be used in a future
adversarial proceeding to establish entitlement or quantum.
Mini Trial
as the name implies, this concept incorporates a trial concept; however, it is
reduced in scope, formality and level of intensity and is presided over by an
independent outside party (not necessarily a judge) who administers the
trial. Expected in attendance are those in authority from the respective sides
who are in a position to reach a settlement. Summary testimony is given, with
cross examination usually by-passed, and the decision makers from each side can
participate during and/or after the trial in order to attempt to come to a
mutually agreeable settlement.
Arbitration
- serve as the sole arbitrator or one of a three-member panel, or serve as a
party arbitrator selected by one of the parties who, in turn, select a third,
neutral arbitrator. This a binding process in which the parties forfeit their
right to a court proceeding. An arbitration decision can be appealed in a court
of law (albeit the right of appeal is very limited in scope).
