Mediation USA, Inc. (MUSA) was founded by President
Sheila Somberg, in 1992. After having
managed Human Resource departments for Fortune 200 companies and graduating
with a MBA from the University of Denver, Ms. Somberg decided to open the doors
of Mediation USA. MUSA was formed to
provide expert human resource consulting, alternative dispute resolution (ADR)
delivery programs, mediations, facilitations, and communication trainings to
government organizations, businesses and environmental groups. Ms. Somberg is a nationally recognized
leader in the field of alternative dispute resolution with 18 years of
experience mediating and facilitating over 4,700 disputes in a variety of
business and interpersonal contexts.
Mediation USA, Inc. consults with governmental
agencies, environmental groups, corporations, and other entities concerning the
most appropriate process or system for a class of disputes, analysis of
institutional issues, selection of neutral(s) and administration of dispute resolution
processes. There are eighteen Associates in six states. MUSA s Associates possess substantive
knowledge of a wide variety of employment, labor, human resource, EEO, and
civil rights issues. Our experts have
had rigorous training in both constitutional and statutory rights, negotiation,
mediation, and extensive practical experience in analyzing and resolving
complex issues.
The Human Potential Institute
The newest division, The Human Potential Group
was formed in 2001. It offers
thirty-two off the shelf classes that can be customized to meet client needs
for flexibility and specialized modifications.

Systems
Consulting consists of five main phases. First,
our consultants thoroughly analyze and understand the needs and goals of the
client. This involves coping with mixed
motivations, and dealing with concerns about exposure and the loss of control,
and entering into a contract with the client.
Second, our consultants
identify who will be involved in defining the problem, deal effectively with
the political climate, determine what kind of data should be collected, how it
should be collected (direct observation, review of company records, personal
interviews, or a survey instrument), and how long that will take. Third,
our consultants structure an appropriate medium to present personal and
organizational data, assist in setting ultimate goals for the project,
determine the most appropriate intervention, and identify the applicable tools
or instruments to support that intervention.
Fourth, our consultants
implement the plan established in phase three, by designing the appropriate
meeting and identifying applicable participants, and facilitating the meeting
(or other intervention). Fifth, our consultants evaluate whether
to extend the process to a larger segment of the organization, whether to
return to the planning phase and a new contract, or whether to terminate the
relationship.
Our consultants have a
proven track record of providing expert advice, assistance, guidance, and/or
coaching in support of agency goals, management, and both organizational and
business improvement efforts. Their

Facilitation is a process in
which a neutral third party empowers people to take control and responsibility
for their own efforts and achievements.
The ability to intervene in the group process in the right way, and at
the right time, is crucial to successful outcomes. A facilitator is useful in three key ways: First, the neutral is
not vested in the outcome of the group, which impacts the participants
perspective of bias. Second, a neutral
can see and hear all issues non-judgmentally, which impacts the emotional
safety of the participants. Third, an
outside neutral can bring a different perspective, and possibly address
underlying assumptions that may not be accurate, or are acting as barriers to
generative learning. Teams, divisions,
partnerships and groups produce greater creativity and work production through
the use of excellent facilitation.
Our facilitators accomplish
empowerment by the use of several skills: 1) Listening, both reflectively and
actively/creatively, 2) Questioning in an enquiring and learning way, 3)
Inviting and encouraging involvement by all
the participants, 4) Supporting the participants in communicating their
thoughts, feelings and ideas clearly, 5) Reviewing and summarizing the ideas
and suggestions, and 6) Adapting to the changing needs of the group. Our facilitators are also conflict
managers. A widely held belief in our
culture is that conflict is bad or abnormal.
Contrary to this belief,
conflict can be a powerful medium for growth, if managed constructively. Facilitators can channel anger or
frustration into creative energy. Our
facilitators have consistently demonstrated the skills necessary for successful
outcomes, as defined by clients. They have handled complex cases involving
whole communities, diverse workplaces, environmental issues, and highly charged
and emotional situations.
